This Website and the underlying telehealth administrative architecture are owned and operated by Prime Protocols Pty Ltd (ABN 74 697 768 237) (“Prime Protocols”). By accessing this Website, submitting an application, or utilizing our administrative booking systems, you agree to be bound by these Terms and Conditions.
1. Scope of Service and Protocol Licensing
Prime Protocols operates an administrative platform that licenses proprietary, evidence-based clinical treatment protocols authored by our Chief Medical Officer.
You explicitly acknowledge and agree that:
* Prime Protocols provides the technical infrastructure, billing systems, and licensed clinical guidelines, but does not directly deliver medical care or clinical services.
* All telehealth consultations, clinical assessments, diagnoses, and prescribing actions are performed solely by independent, fully qualified medical practitioners contracting with the clinic.
* The treatment protocols licensed by our Chief Medical Officer serve as evidence-based guidelines only. The individual consulting practitioner retains absolute, unreduced clinical sovereignty and is solely responsible for exercising their independent professional judgment to determine if a protocol is safe and appropriate for your specific medical needs.
2. Absolute Exclusion of Emergency Services
The Prime Protocols platform, website, and licensed treatment programs are designed strictly for scheduled, non-emergency telehealth care and monitoring. This platform must not be used under any circumstances for emergency medical events. If you are experiencing an acute medical crisis, sudden severe symptoms, or life-threatening conditions, you must dial 000 immediately or attend the nearest physical hospital emergency department.
3. Integrated Booking and Account Security
Patient onboarding, intake forms, scheduling, and health record entries are processed via an integrated interface supplied by our third-party provider, Halaxy. You warrant that all information provided through this interface is complete and accurate. You are solely responsible for protecting any personal access links, passwords, or login credentials associated with your account.
4. Financial Terms, Cancellations, and Refunds
* Private Billing: All treatments and consultations facilitated via Prime Protocols are conducted strictly on a private billing basis. Consultation fees must be paid in full at or before the time of booking.
* Cancellation Framework: Patient cancellations made with more than 24 hours’ notice are entitled to a full refund. Cancellations made with less than 24 hours’ notice, or failures to attend a scheduled session, may result in the forfeiture of the consultation fee under our platform standard cancellation guidelines.
* Rescheduling: If a practitioner is unable to attend a session due to unforeseen circumstances, the clinic will provide a priority reschedule or a full refund.
5. Intellectual Property Protection
All content, designs, clinical intake workflows, calculators, software code, and the specific clinical treatment protocols developed by our Chief Medical Officer are the exclusive, proprietary intellectual property of Prime Protocols Pty Ltd and are protected under Australian copyright and trademark laws.
Contracted doctors and patients are granted a limited, personal, non-transferable, and revocable license to interact with these protocols strictly within the boundaries of a platform-facilitated consultation. Any unauthorized copying, distribution, modification, or external replication of our protocols or website assets is strictly prohibited.
6. Limitation of Liability and Clinical Disclaimers
To the maximum extent permitted by the Australian Consumer Law (ACL) and the Competition and Consumer Act 2010 (Cth):
* Prime Protocols (including its officers, directors, and employees) explicitly disclaims all liability for civil medical malpractice, clinical negligence, treatment outcomes, or prescribing errors committed by the independent contract practitioners.
* The consulting medical practitioner holds 100% sole professional liability for all clinical decisions, protocol deviations, or prescriptions issued to you.
* Prime Protocols will not be liable for any indirect, consequential, special, or punitive damages, or any loss of profits, data, or business opportunities arising out of platform downtime or software delivery issues.
7. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Queensland, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland and any courts authorised to hear appeals from them to resolve any contractual disputes.
